Lo2 M2 Legal and ethical issue when filming

I have been commissioned by the Doncaster Council to take photos that show the beauty that is hidden in Doncaster. This will result in me interacting with people in public spaces. This is my report about the legal and ethical considerations that I will need to follow when shooting outside in public. If I do not follow these requirements, I could potentially cause harm to people or damage the equipment I am using. 



Legally, I am allowed to shoot outside in public. It isn't illegal to film or capture people in shots as long as they are in a public space. If I am taking photographs from private land, you need to have the land owner's permission. With this though, there are many ethical considerations that I would need to consider before taking pictures of people. I do not want to capture photos like Bruce Gillman as he purposefully gets close to peoples face in order to capture a picture that shows the shock and the chaos of a busy city in New York. This is very unethical as it completely disregards the personal space of the person in public. Even with this, I will still take pictures that may have people in. I will just make sure to keep in mind how I am taking the photo and how the subject in the photo reacts to their picture being taken. Further more, I will need to ensure I do not take photos on private land or land owned by someone. If I do take a picture on private land, I will need to ensure that I have a location release form which will let me use the picture after its taken. If I am asked to stop taking photographs on private property then it is advisable I do so. The person asking might not have the legal right to do so but it is likely that the actual landowner will side with them rather than me. Taking pictures in private property without permission could be seen as harassment, invasion of privacy, or trespassing. So in Doncaster, the French gate, or any shops and stores will be privately owned meaning I will not be able to shoot in them. However, the railway station in Doncaster is a public space meaning that I can shoot there if I want to.

If I plan on using models or taking any portrait images. I will need to obtain a model release form which establishes a contract between the photographer and a model and defines how and where photographs may be used. It protects both the photographer and the model in the event of any dispute. The form includes the rights of the image owner, the customer, and the model to prevent any lawsuit or settle any future complications. You will need it if you photograph professional models or candid photo shoots. In an ideal case, a photography model release form should be short and sweet. It needs to contain the photographed persons’ name, address, phone number, and a witness. However, there are much longer versions used for more important, commissioned work. The shorter versions are more for unplanned photographs. I do not plan on using a model within my photos, but If I decide to shoot an unplanned photo that includes a model as the subject, I will need a short concise release form that can ensure I have the rights to the photo. Ethically taking pictures of peoples children may seem weird, and could give people the wrong idea about what I am doing. While I do not want to include children in my photography, I will always ask someone for permission if I would like them to be in the shot. 




To ensure my images aren't indecent or offensive, I will stray away from including offensive content that could hurt or offend people. I must not include any nude or naked content in my images, and they must not include offensive imagery or logos and be unethical. When I take photos I will ensure that no people will be in the shot as to not include any potential offensive content. Along with this, I must make sure as to not disturb the peace when I am shooting photos. To do this I must be aware of my surroundings and make sure that I take images in places that could affect people or vehicles.
